Terms of Service

By accessing or using the Zignage (including but not limited to zCast, zCloud, zCAS, zCore) platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Zignage Platform.

  1. License: Subject to your compliance with these Terms, Zignage grants you a non-exclusive, non-transferable, revocable license to access and use the Platform for your internal business purposes during the term of your subscription.
  2. User Accounts: To access the Zignage Platform, you may need to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to promptly update your account information as needed.
  3. Intellectual Property: The Zignage Platform, including its software, content, design, and other materials, are owned Zignage or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the Platform or its content without Zignage’’s prior written consent.
  4. Acceptable Use: You agree to use the Zignage Platform in compliance with all applicable laws and regulations and in a manner that does not infringe upon the rights of others or interfere with the operation of the Platform. You may not use the Platform to transmit, store, or display any content that is unlawful, harmful, offensive, defamatory, or otherwise objectionable.
  5. Subscription and Fees: Your use of the Zignage Platform may be subject to a subscription fee, as specified on the Platform or in a separate agreement with Company. You agree to pay all applicable fees in a timely manner. Failure to pay fees may result in suspension or termination of your access to the Platform.
  6. Privacy: Zignage’s collection, use, and disclosure of your personal information are governed by its Privacy Policy, which is incorporated into these Terms by reference. By using the Zignage Platform, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
  7. Limitation of Liability: Zignage’s liability for any claims arising out of or related to your use of the Zignage Platform is limited to the amount you paid for your subscription during the six (6) months prior to the claim. Company is not liable for any indirect, incidental, consequential, or punitive damages, or for any loss of profits or revenue.
  8. Termination: These Terms may be terminated by Zignage for any reason, with or without cause, upon notice to you. You may also terminate these Terms by discontinuing your use of the Zignage Platform. Upon termination, you must immediately cease all use of the Zignage Platform and delete any copies of the Platform in your possession.
  9. Modifications:Zignage may modify these Terms at any time by posting the updated Terms on the Zignage Platform or by notifying you by email or other means. Your continued use of the Zignage Platform after such modifications constitutes your acceptance of the updated Terms.
  10. Governing Law and Jurisdiction: These Terms are governed by the laws of New York State USA, without regard to its conflict of laws provisions. Any disputes arising out of or related to these Terms or the Platform shall be resolved exclusively in the courts of New York.
  11. Entire Agreement: These Terms constitute the entire agreement between you and Company with respect to your use of the Zignage Platform and supersede all prior or contemporaneous understandings or agreements, whether written or oral, relating to the Platform.
